Terms of Service

1. Acceptance of Terms
By accessing and using Gubbin ("the Platform"), you accept and agree to be bound by these Terms of Service and all applicable laws and regulations. If you do not agree to these terms, you must not use the Platform.
These terms constitute a legally binding agreement between you and Gubbin Ltd, a company registered in England and Wales. By creating an account or using any services, you confirm that you are at least 18 years of age and have the legal capacity to enter into this agreement.
2. Description of Service
Gubbin is a marketplace platform that connects hospitality venues with certified equipment repair technicians. We facilitate:
- Job postings for equipment repair, maintenance, and installation
- Matching venues with qualified, certified technicians
- Secure communication between parties
- Marketplace payment processing via Stripe Connect
- Review and rating systems for quality assurance
- Equipment management and service record tracking
- AI-assisted equipment diagnostics
- Rental equipment marketplace for interim solutions
Gubbin acts as an intermediary platform. We are not a party to the contracts formed between venues and technicians. We do not employ technicians, and technicians provide their services as independent contractors.
3. User Accounts
To use the Platform, you must create an account. You are responsible for maintaining the confidentiality of your account credentials and for all activities that occur under your account. You agree to:
- Provide accurate, current, and complete information during registration
- Update your information promptly to keep it accurate and current
- Notify us immediately of any unauthorised access or use of your account
- Accept responsibility for all activities that occur under your account
- Not share your account credentials with any other person
- Not create multiple accounts for the same business entity
We reserve the right to suspend or terminate accounts that contain false, misleading, or fraudulent information.
4. User Responsibilities
4.1 Venues
Venues registering on Gubbin agree to:
- Provide accurate job descriptions including equipment type, issue details, and urgency level
- Respond to technician offers in a timely manner
- Provide safe and accessible working conditions for attending technicians
- Approve contractor payouts promptly upon satisfactory completion of work
- Provide honest and fair reviews of work completed
- Maintain accurate equipment records on the platform
4.2 Technicians
Technicians registering on Gubbin agree to:
- Provide accurate qualifications, certifications, and insurance information
- Maintain valid Gas Safe, electrical, or other relevant certifications where applicable
- Hold appropriate public liability insurance (minimum £1 million recommended)
- Complete work to the agreed standard and within the specified timeframe
- Submit accurate completion reports and documentation
- Not contact venues outside the platform to circumvent fees
- Comply with all applicable health and safety regulations
5. Payments and Fees
Registration on Gubbin is free for both venues and technicians. There are no subscription fees or sign-up charges.
5.1 Marketplace payments (Stripe)
Job payments are processed by Stripe as our payment partner. When a venue accepts a technician's offer or quote, the agreed amount is charged or authorized through Stripe. Gubbin deducts a platform introduction fee. The balance is transferred to the technician's Stripe Connect account after the venue confirms satisfactory completion (or according to our dispute process).
Gubbin is a marketplace platform, not a bank, escrow agent, or payment institution. Funds are processed under Stripe's terms and the regulations applicable to Stripe and connected accounts.
5.2 Platform Fee
Gubbin deducts a platform fee of 10% of the job value from the technician's payment as an introduction fee. This fee covers:
- Platform access and job matching
- Secure payment processing and Stripe Connect payouts
- Dispute resolution services
- Customer support
5.3 Five-Star Rebate
Technicians who receive a 5-star review from a venue on a completed job are eligible for a 2.5% rebate on that job's value, reducing the effective platform fee to 7.5%. This rebate is credited automatically following the submission of a qualifying review.
5.4 Currency and Tax
All prices and payments are in British Pounds Sterling (GBP). Technicians are responsible for their own tax obligations, including VAT registration and self-assessment returns. Gubbin provides annual payment summaries to assist with tax reporting.
6. Dispute Resolution
In the event of a dispute between a venue and technician:
- Either party may raise a dispute through the platform within 14 days of job completion
- Gubbin will review evidence from both parties, including messages, photos, and completion reports
- We will attempt to mediate a fair resolution within 10 working days
- Pending payouts will be held pending dispute resolution
- Our decision is final and binding unless otherwise required by law
Nothing in these terms affects your statutory rights under UK consumer protection legislation.
7. Prohibited Activities
You agree not to:
- Use the Platform for any unlawful purpose
- Post false, misleading, or fraudulent information
- Circumvent payment processing or platform fees by arranging direct contact outside the platform
- Harass, abuse, threaten, or discriminate against other users
- Upload malicious software, viruses, or harmful content
- Scrape, crawl, or use automated tools to access the Platform without authorisation
- Impersonate another person or entity
- Infringe on intellectual property rights of Gubbin or other users
- Violate any applicable laws, regulations, or these Terms of Service
8. Intellectual Property
All content on the Platform, including text, graphics, logos, software, and the"Gubbin" brand, is the property of Gubbin Ltd or its licensors and is protected by copyright, trademark, and other intellectual property laws.
Users retain ownership of content they upload (photos, reviews, job descriptions) but grant Gubbin a non-exclusive, royalty-free, worldwide licence to use, display, and distribute such content in connection with the Platform's operation.
9. Limitation of Liability
Gubbin acts as a marketplace platform connecting venues and technicians. To the maximum extent permitted by law:
- We are not responsible for the quality, safety, or legality of services provided by technicians
- We do not guarantee the accuracy of user-provided information, including certifications and qualifications
- We are not liable for any indirect, incidental, special, consequential, or punitive damages
- Our total aggregate liability shall not exceed the amount of fees collected from you in the preceding 12 months
Nothing in these terms excludes or limits liability for death or personal injury caused by negligence, fraud, or any other liability that cannot be excluded by law.
10. Indemnification
You agree to indemnify and hold harmless Gubbin Ltd, its officers, directors, employees, and agents from any claims, damages, losses, or expenses arising from your use of the Platform, violation of these terms, or infringement of any third-party rights.
11. Termination
We reserve the right to suspend or terminate your account at any time for violation of these terms or for any other reason we deem necessary, with or without notice. You may terminate your account at any time by contacting support.
Upon termination, any pending marketplace payments will be resolved according to our dispute resolution process. You may request a data export before account closure in accordance with yourGDPR rights.
12. Data Protection
Your use of the Platform is also governed by ourPrivacy PolicyandGDPR Compliance Policy. We process personal data in accordance with the UK GDPR and Data Protection Act 2018.
13. Governing Law
These terms shall be governed by and construed in accordance with the laws of England and Wales. Any disputes arising under these terms shall be subject to the exclusive jurisdiction of the courts of England and Wales.
14. Changes to Terms
We may modify these terms at any time. Material changes will be notified via email and platform notification at least 30 days before they take effect. Continued use of the Platform after changes constitutes acceptance of the new terms.
15. Severability
If any provision of these terms is held to be invalid or unenforceable, the remaining provisions shall continue in full force and effect.
